Pre-Procurement Requirements for Acquisitions Known to Include GenAI - 2302

(New: 09/2024)

Before proceeding with a GenAI purchase, releasing a solicitation that includes the purchase of GenAI, or approving a contract that includes services generated by GenAI, procurement professionals must confirm with their department Chief Information Officer (CIO) that the purchase may proceed. Confirmation must be kept in the procurement/contract file and can be an email, or a form created by the department.

CIOs are required to conduct a risk assessment and potential consultation with the California Department of Technology (CDT) before proceeding with a purchase that includes GenAI (refer to Technology Letter 24-01 for details). Consultation with CDT is dependent upon the risk assessment outcome.

For risk assessment and consultation requirements during the solicitation process, check the "Solicitations – GenAI Requirements" section 2304 of this chapter.

To review guidelines on sharing active procurement information with CIOs, visit the "GenAI Procurement Process & Confidentiality" section 2309 of this chapter.
