Special Provisions – GenAI - 2304.3

The GenAI Special Provisions are applied on a case-by-case basis and not made available for use by departments without the California Department of Technology’s (CDT) recommendation.
CDT may identify the need to incorporate specific GenAI Special Provisions as a result of a Chief Information Officer (CIO) consultation with CDT. When a CDT GenAI consultation indicates the need for special provisions related to the GenAI technology function or service, CDT will require and provide GenAI Special Provision language.
No changes are permitted to the GenAI Special Provisions or any other state standard terms and conditions without the prior approval of CDT/DGS.
No solicitation shall be released, nor shall any contract be executed for the procurement of “Moderate” or “High” risk GenAI technology functions or services until CDT has reviewed and approved the use of GenAI Special Provisions for the solicitation and contract (refer to TL 24-01 for risk assessment requirements).Revisions
