Buy Clean California Act Program
The Buy Clean California Act (BCCA) (Public Contract Code Sections 3500-3505), was enacted in October 2017 in an effort to reduce greenhouse gas emissions released during the manufacture and transport of products used in public infrastructure projects. Real Estate Service Division (RESD) requires submittals of Environmental Product Declarations (EPDs) for eligible materials (carbon steel rebar, structural steel, flat glass, and mineral wool board insulation) on construction contracts for Major Capital Outlay projects, entered into on or after July 1, 2022.
Requirements
The BCCA requires submittal of Environmental Product Declarations for eligible materials or products, including carbon steel rebar, structural steel, flat glass, and mineral wool board insulation.
For eligible projects with contracts signed on or after July 1, 2022, contractors must submit facility-specific material or product EPDs before the material will be accepted for installation. The Environmental Product Declaration must show that the facility-specific global-warming potential of the material or product does not exceed maximum global-warming potential (GWP) value as published by the Department of General Services Procurement Division.
Materials with GWPs greater than the threshold value cannot be used on eligible projects. If the contractor fails to both provide an EPD for an eligible material and receive State’s acceptance, installation may not proceed and compensation may be withheld, and/or the contractor may be liable for all costs associated with removal of an eligible material installed prior to State’s review and acceptance.
Eligible Projects for Real Estate Services Division
Environmental product declarations are only required for eligible materials on Major Capital Outlay projects construction contracts.
Submission Process
Contractors must submit facility-specific material or product EPDs to their RESD Project Director / Project Manager for review before the material will be accepted for installation. Project Design Team will review the submittal for compliance. At the project closeout, Project Director / Project Manager will submit the EPDs to Project Support Admin for uploading to the DGS Procurement Division website.
