Office Chiefs

  • All Office Chiefs will review their organizations at least once a year to ascertain whether there are any positions that should be added to (or removed from) the group of classifications designated as "sensitive positions". (The Substance Abuse Program Administrator can be contacted for criteria to identify sensitive position needs.) The Office of Human Resources will be informed of the results of these reviews and will take appropriate action on behalf of DGS.

Managers

  • All DGS managers and supervisors whose staff include persons serving in "sensitive positions" as that term is used in the CalHR Substance Abuse Regulations (Title 2, California Code of Regulations (CCR) sections 599.960-599.966) will maintain a copy of those regulations and be familiar with their provisions.
  • Any DGS manager or supervisor whose staff includes positions that require a commercial Driver License shall be familiar with Federal Department of Transportation substance testing requirements.
  • Any DGS manager or supervisor whose staff includes employees subject to any substance testing procedures or requirements shall ensure that those procedures and requirements are complied with in a timely and appropriate manner.
  • All DGS managers and supervisors shall take appropriate action promptly upon learning about a violation of this policy.

Employees

  • Regardless of any substance testing that may be done, all DGS personnel are responsible for adhering to the policy stated at Title 2 CCR section 599.960(b), which states "… no State employee who is on duty or on standby for duty shall either (1) use, possess, or be under the influence of illegal or unauthorized drugs or other mind-altering substances, or (2) use or be under the influence of alcohol to any extent that would impede the employee’s ability to perform his or her duties safely and effectively. Violation of this policy may result in adverse action up to and including dismissal."
  • Any employee concerned about his/her use of alcohol or drugs is encouraged to contact Magellan Healthcare for Employee Assistance Program (EAP) services. EAP provides confidential, professional assessment and referral services. Their number is 1-866-327-4762. Magellan Healthcare has staff available 24 hours a day.

NOTE: When an adverse action (less than dismissal) is taken against an employee for substance abuse, the department will assist the employee through referral to the departmental EAP provider, Magellan Healthcare (see above).
